other IP rights
We help our clients consider all aspects of their business and what rights are appropriate for them. These include the less common and more specialised rights available and we work with our clients to identify the practical as well as legal solutions required for them.
Some of the other relevant rights are set out below:
statutory rights
There are various other type of statutory intellectual property rights which are more specialised, such as design rights and database rights. These are most closely related to copyright and can sometimes exist alongside it or to protect different aspects of the same thing.
passing off
This is an old common law remedy for protecting trading names and other branding from use by others. It is designed to protect the reputation and goodwill established in a name and prevent that from being misappropriated by others. This remedy is often used when a name is not a registered trade mark.
confidentiality
Often the best way to protect your ideas and information is through strict confidentiality structures. This is used for things which do not qualify for other protection, such as know how, and is often preferred to registration of a patent, which will require publication. The area of confidentiality touches many different parts of a business, such as employment and supplier relationships, and therefore requires detailed and thorough integration into a business.
